Terms of service

These terms are the agreement between you and Playsthetic LLC ("we", "us") for using Curiomancer, a service for finding shops, bars, and restaurants through people who share your taste, on the web and in our iOS and Android apps. By creating an account or using Curiomancer, you agree to them. Our Privacy policy explains how we handle your data.

Who we are

Curiomancer is a brand of Playsthetic LLC, a company registered in the United States, which runs it. To reach us about anything, write to [email protected]. Under Articles 11 and 12 of the EU Digital Services Act, that address is also our single point of contact for authorities in the EU and for anyone using Curiomancer. Who can use Curiomancer

You must be 18 or older. Curiomancer is invite-only, so you need an invitation from a member or from us to create an account. You can't use Curiomancer if the law forbids you from doing so, or if we've removed your account before.

Your account

Keep your password to yourself and your details accurate. You're responsible for what happens on your account. If you think someone else has access to it, change your password and tell us.

Curiomancer World

Your content

You own what you post on Curiomancer, such as your ratings, messages, name, and profile photo. To run the service, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, and display that content, and to deliver it to the people it's meant for. That includes using your ratings, without revealing you, to compute recommendations and matches for others, even while you're Incognito. The licence ends when you delete the content or your account, except for the copies we keep as the Privacy policy describes, such as reports. Only post content you have the right to share.

Rules of conduct

We have zero tolerance for objectionable content and abusive users. You may not use Curiomancer to do any of the following.

• Harass, bully, threaten, stalk, or intimidate anyone.
• Post hate speech, or attack people for who they are.
• Send sexual content, or anything that sexualises a minor.
• Spam, scam, or advertise.
• Impersonate someone or lie about who you are.
• Share someone else's personal information without their permission.
• Post anything illegal, or anything that infringes someone else's rights.
• Get around a block, a suspension, or a removal, including with a new account.
• Manipulate recommendations or matches with fake accounts or fake ratings.
• Scrape the service, collect other members' data, or try to work out someone's ratings from what Curiomancer shows you.
• Disrupt or attack the service, or access it in ways we don't offer.

Breaking these rules can get your content removed and your account suspended or terminated, without warning in serious cases.

Blocking and reporting

On the website, you can block someone from your conversation with them or from their profile. In the apps, you can block them from your chats or from their twin card. Blocked people can't see your profile, message you, or appear among your twins, and you won't see them either. You can unblock people in Settings.

You can report someone, or a single message, from the same places, and a shared map from its page. Reporting someone doesn't notify them. For anything else, including illegal content, email us. So we can act on it, please include the following.

• Where the content is, such as a link to the profile or shared map, or which message.
• Why you believe it's illegal.
• Your name and email address, unless you're reporting child sexual abuse material.
• A statement that you believe in good faith that your report is accurate and complete.

How moderation works

A person reviews every report and every notice sent to us, promptly. We don't use automated moderation. Depending on what we find, we may remove content, restrict someone's messaging, suspend their account, or terminate it, and we report content to the authorities where the law requires it. We decide based on these terms and the law.

When we act against your content or your account, we email you what we did and why, unless the law or someone's safety prevents it. If you think we got it wrong, reply to that email. A person will look at it again and tell you the outcome.

Copyright

Our designated agent for copyright notices under the US Digital Millennium Copyright Act is Playsthetic LLC, by post at 2108 N St #6842, Sacramento, CA 95816, United States, by phone at +1 (510) 337-4660, and by email at [email protected]. If you believe something on Curiomancer infringes your copyright, email the agent the following.

• Your physical or electronic signature.
• The copyrighted work you believe is infringed.
• The material you believe infringes it, with enough information for us to find it, such as a link.
• Your address, telephone number, and email address.
• A statement that you believe in good faith that the use isn't authorised by the copyright owner, its agent, or the law.
• A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act for them.

If we remove your content after a notice and you believe that was a mistake, send a counter-notice to the same address with the following.

• Your physical or electronic signature.
• What was removed, and where it appeared before.
• A statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification.
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you're outside the US, any judicial district where we may be found) and will accept service of process from the person who sent the notice.

We forward the counter-notice to the person who sent the notice, and may restore the content in 10 to 14 business days unless they tell us they've gone to court. We terminate the accounts of repeat infringers in appropriate circumstances. Knowingly misrepresenting that material infringes, or that it was removed by mistake, can make you liable for damages.

API tokens

You can create API tokens in Settings to use your own data elsewhere. They're for your personal use, including connecting your data to apps you choose. Keep them secret. A token with full access can read and send your messages, so only give it to apps you trust, and remember you're responsible for what's done with your tokens. Don't use the API to collect other people's data or to run a service for others. We apply rate limits, and we may limit, suspend, or revoke tokens at any time, for example to stop abuse or protect the service.

Third-party services and content

Maps and place information come from Apple Maps and are subject to Apple's terms. City names come from OpenStreetMap through its Nominatim service, © OpenStreetMap contributors, available under the Open Database License. Venue photos are the preview images venues publish on their own websites, and they belong to their owners, as do venue names, logos, and websites. If you own something shown here and want it removed, email us. Links to venue websites and to Stripe take you to services we don't control, under their own terms.

Our photo fetcher

To find a venue's photo, our server visits the website Apple Maps lists for that venue and reads its preview image tag. It identifies itself as CuriomancerBot/1.0 (+https://curiomancer.com/terms#bot) and follows robots.txt, using the rules for CuriomancerBot or, if there are none, the rules for all robots. If your robots.txt returns an error other than not found, or can't be reached, it stays away. To block it, add this to your robots.txt.

Meeting people

We don't verify who members are or run background checks. Be careful about what you share, and take care if you meet someone in person. You're responsible for your dealings with other members.

Disclaimers

Curiomancer is in beta. We provide it as is and as available and, to the extent the law allows, without warranties of any kind, express or implied, including of merchantability, fitness for a particular purpose, and non-infringement. Place details, photos, recommendations, and matches can be wrong or out of date, so check before you go. We may change, suspend, or stop features at any time.

Limitation of liability

To the extent the law allows, we aren't liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service, your dealings with other members, or places you find through it. Our total liability for any claim about the service is limited to the greater of what you paid for World in the 12 months before the claim and US$50.

Nothing in these terms limits liability that the law doesn't allow us to limit, such as for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct. If you're a consumer in the EU or the UK, we're responsible for foreseeable loss caused by our breach of these terms or our failure to use reasonable care, and your statutory rights are not affected.

Governing law and disputes

These terms are governed by the laws of California, United States, without regard to its conflict-of-law rules. Disputes go to the state or federal courts in Los Angeles County, California. If you're a consumer in the EU, the UK, or another country whose law gives you mandatory protections, you keep those protections, and you can bring a claim in the courts where you live.

California consumers

Curiomancer is provided by Playsthetic LLC, 2108 N St #6842, Sacramento, CA 95816, United States, +1 (510) 337-4660. It's free to use, and the optional World plan costs US$2.99 a month, including any applicable tax. Under California Civil Code section 1789.3, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.

Changes to these terms

When these terms change, we update the date at the top. For material changes, we'll tell you by email or in the app before they take effect. If you keep using Curiomancer after that, the new terms apply. If you don't agree, you can delete your account. We record which version you accepted when you signed up.

Ending your account

You can delete your account at any time, from Settings on the web or in the apps. See how to delete your account. We may suspend or end your account if you break these terms or if the law requires it. If we shut Curiomancer down, we'll give you reasonable notice. The parts of these terms that should naturally outlast your account, such as the disclaimers, the limits on liability, and governing law, still apply after it ends.
